Guardianship Matters

When an individual is unable to make informed healthcare or financial decisions, or if they do not have a legal agent, a Guardianship Petition may be needed to ensure the Court appoints a legal agent to act on that individual's behalf. Toolin Law can assist with Petitioning the Court for the appointment of a Guardianship of the Person and/or Estate. 

Advance Directives

If an individual has capacity to elect a legal agent to act on their behalf to make healthcare and/or financial decisions, Toolin Law can assist with creating a Financial Power of Attorney, Healthcare Power of Attorney, Health Care Proxy, and/or Living Will documents, to ensure a person's choice to make informed decisions on their behalf when they no longer can.

Wills and Trust

Toolin Law can help provide education to determine the best course of planning for your loved ones. 100% of people need Estate planning and we will work with you to determine your needs and budget depending on your goals. Creating a Trust will help your loved ones avoid probating your estate upon your death avoiding additional fees and cost that are associated with probate. However, many people prefer to have a will drafted that can be revoked or changed easily without needing to retitle their assets. Toolin Law can help navigate this decision with you.

Elder Abuse

Advocating for the protection of an elderly individual is very important to our practice. We can assist with reporting and advocating an elderly individual's rights. 

Medicaid Assistance

Filing for long-term care Medicaid benefits can be overwhelming. Toolin Law can help assist with all aspects of a Medicaid application from the application submission, to obtaining all required verifications, education on Medicaid spend down, communication with the Department of Health and Human Services, and filing of an appeal if needed.

Litigation

Litigation can be costly and timely. It should be a last resort when other avenues have been exhausted. Toolin Law offers a variety of legal representation for litigation claims. Long Term Care Discharge Proceedings

From the start of discharge proceedings at the issuance of a Notice of Intent to Discharge, to representation at an appeal hearing, we can assist with all aspects of a discharge proceeding. 

Estate Adminstration

Toolin Law can serve as legal representation of an estate in addition to serving as the Estate's Administrator if needed. We can assist with all areas of probating and estate from filing the petition to distribution of the estate's assets to the beneficiaries to closing of the estate.

Attorney Toolin has worked in the long-term care field since 2009. Her entire nursing career was dedicated to the long-term care industry. As an attorney she continues to bring dedication to preserve the long-term care industry and the elderly population they serve. She obtained her associate's degree in nursing and then pursued a bachelor's degree in nursing (BSN) while working full-time. She then obtained her Juris Doctor (JD) while also working full-time. Her dedication to helping other is a core reason she started her own law practice.
